  1. Applications

Applications for a stall will be considered by the TEGretail Market Management team, who will make a decision based on the information in the application. It may not be possible to allocate everyone to a pitch, who has applied. In the event of applications outweighing the number of stalls available, reservations will be at the discretion of the TEGretail Market Management team. Stall locations will be fairly allocated, circulating traders each month where needed. 

 

  1. Stall Fees, Insurance and Risk Assessments 

Stall fees are set out on the TEGretail website and market correspondence sent with the successful application notification. 

The pitch fee must be paid 3 days before the market at the latest. Failure to pay the stall fee on time without good reason is a breach of these conditions and the trader won’t be guaranteed a stall on any future TEGretail market. 

All fees to be paid via the ‘stripe’ link provided in the market correspondence sent to successful stall traders. 

All traders must provide a completed Risk Assessment. Templates for these can be found on the TEGretail website. 

Each trader must hold and maintain adequate insurance, including Public Liability Insurance covering outside events. All staff, including casual staff, who are employed at the stall, must be covered by Trader’s Employee Liability Insurance. 

 

  1. Cancellations and Refunds

A credit or refund of the payment will be given for any market day where adverse weather or other conditions beyond control could adversely affect trade safety. 

If a trader is asked to leave the market for non-compliance with the terms and conditions, no refund will be payable. 

If the trader is unhappy with the stall location or the Gazebo provided and chooses not to trade, payment will not be refunded or credited. 

All payments received on booking are non-refundable, unless stated when cancelling the market for reasons such as adverse weather. 

 

  1. Setting up and Attendance

Stalls will be made available from 8:30am. Setting up must be completed for opening time at 10am. All traders are asked to arrive no later than 9am. 

All traders are expected to stay the full length of the market. Failure to do this could harm any future bookings with any TEGretail Market. 

 

  1. Gazebos and Pitches

All Gazebos and tables that TEGretail provides are owned by TEGretail. We ask that care is taken while trading from them. 

All traders are provided with the option of 1 to 3 sides. These must be removed and folded at the end of the market trading hours. 

We ask 1 side is used, when the gazebo stands alone. This is for tidiness and trader security reasons. 

If traders are providing their own gazebos and tables. Assembly and disassembly are their own responsibilities. 

 

  1. Adverse Weather

Markets will operate in varying weather conditions, and traders must be prepared for all weather. 

In extreme weather, the TEGretail Market Management team will be responsible for assessing the conditions and if it is considered unsafe to run, the market will be cancelled. The cancellation will be emailed to ALL traders booked onto the market once this decision has been made. We will endeavor to do this as soon as possible. 

TEGretail will not be responsible for any costs incurred by traders if a market is cancelled. 

 

  1. Food Stalls

Traders who sell foodstuffs must comply with the requirements of current food hygiene and food safety regulations. Traders selling food must comply with the law by registering their food business with their local authority (where the vehicle or equipment/food is kept overnight) and copies of the food registration must be made available to the TEGretail Market Management team on request. 

TEGretail does allow alcohol sales on stalls. However, we will need to be provided with permission to sell proof, which can be obtained from Cumberland Council. 

All food traders are required to display their business name on their stall. 

All food traders must register their businesses, and comply with Trading Standards, Environment Health and any other relevant regulatory bodies.  

 

  1. Waste and Convenience provisions 

Bins are located throughout the market sites for general use.  

Traders are responsible for keeping their site and surrounding area clean and tidy. This is throughout the market and vacating the allocated area. 

 

  1. Traders Code of Conduct and Responsibilities

Traders and their staff must behave in a polite and courteous manner. To both the market team and the public. 

Traders must respond co-operatively to any direction given by the TEGretail Market Management team in relation to the operation of their stall, goods, and vehicle during operating times.  

Traders cannot sublet their pitch to anyone else. 

TEGretail promotes an ethos of inclusivity and will not tolerate discrimination and/or criminal behaviour on the grounds of race, religion, sexual orientation, gender status, disability or any other form of personal characteristics. Please see the separate TEGretail Equality Policy. 

Traders must ensure that their activities do not endanger the safety or security of any people in the market. 

Traders must report to the TEGretail Management team any incident or accident to any person or property that involves loss or could be expected to give rise to a claim. 

No trader will be permitted to sell real or reproduction firearms or weapons, any weapons that can propel an object, fireworks, counterfeit goods, drugs or offensive publications or material. 

 

  1. Discipline

Any trader who is found to have breached these terms and conditions may not be able to attend any future TEGretail markets or events 

 

  1. Warranties and Representations of Traders 

The trader is the owner of the approved products with full power and capacity to sell them to a third party without any encumbrance. 

The trader is responsible for obtaining all relevant permits and permissions required to operate the trader’s business and to ensure that all merchandise sold complies with all relevant safety and compliance standards and retails laws currently in force. 

The trader will observe Trading Standards’ requirements with respect to the sale of age restricted goods to young people. 

The trader will not bring into the market any goods or materials of an especially combustible, inflammable or explosive nature. 

The trader will comply with all the terms contained in these terms and conditions and any market byelaws that may be adopted. 

The trader acknowledges and agrees that TEGretail is not liable for any claim or loss suffered or incurred by the trader in relation to or in connection with his business on the market. 

 

  1. TEG Representations 

TEGretail may amend or add to these terms and conditions from time to time. Please re-read before every market application.
